ATF to remove CLEO requirement?

Postby John A. » Tue Dec 06, 2011 12:25 pm

I have been hearing some rumors through the grapevine that the ATF/DOJ has agreed to remove the Chief Law Enforcement Officer (CLEO) requirement on NFA forms to be submitted pending further examination.

If this is true, I see it as a blessing to those who could never get a signature due to personal or political reasons.

There is a multiple page discussion topic at uzitalk for those of you who would like to read it.

We have heard the same here - with the esteemed Mr. DTM leading the front...

Certainly would be nice! I'm always sure to make friends with any LEO's I come across but there's no telling if you get one that's scared of NFA stuff. I've heard horror stories about some folks not being able to get it. I'm going to write up a living trust with my wife (since she shoots too, and has full access to everything I have) so that requirement won't apply. (We both have our CHL's so it's not like we haven't been through background checks, etc. already.)

I agree Ken73. It will be more handy for a lot of people if it goes through.

Even for those like myself that can get signatures, being able to omit that step is still more convenient than trying to catch the Sheriff in his office on any given day/time or worst, having to schedule an appointment and making multiple trips back and forth dropping off paperwork and then going back to pick them up. :bang:

I wish I had started a trust to begin with, but I have so many stamps at this time, it would be counterproductive for me to do it any differently now.

My wife very seldom shoots so, that isn't an issue for us. If she is shooting, we're together

It isn't even a thing in my county, as the sherrif signs them without batting an eye; but for buddies of mine in neighboring counties, it'll be a blessing.

From my understanding, this has been in the works for years with the NFATCA I remember reading about it earlier this year. The only thing is the NFATCA forums have gone silent since about may of this year, ever since their website got hacked.

I believe the NFATCA has been working for years to remove the CLEO requirement. Also the ATF has admited that since Trust have started to become more popular because the main reason for using them to aquire NFA firearms has been because the local CLEO's have refused to sign off, they have actually approved transfers for felons.

Some think this will increase the number of applications for Transfers or Manufacturing NFA firearms, but I don't think it will. Those that have already formed a TRUST will continue to use them. Those that are getting started with collecting NFA firearms will probably opt for the indivudal route since you won't have to shell out the extra $$ for a lawyer to create a trust for you.

Plus with a trust you have to send in all the pages of it everytime you send in a Form 1 or Form 4 etc.. While with the indivudal route you have do have the finger print cards and pictures but nothing else extra. Also when you get the approved forms you only need a copy of it to carry with you (even though I know it's not required by a good practice) and not have to take all 20 something pages of the trust with you too.

If it does go through (not saying that it's a done deal), I think it will make it easier for the reasons I already stated above.

It would certainly make an impulse submission easier.

I always keep a few extra sets of paperwork handy just in case.

Who knows when I may want to shorten the barrel on my shotgun or make a new silencer
